This is in reply to your letter of 20 April 1967.
The records on file at this office of the men from New York State who served in the Civil War, show the following.
Winfield Scott. Age, 25 years. Enrolled to serve three years, and mustered in as Captain, Company C, 126th New York Volunteer Infantry, August 9, 1862; surrendered, September 15, and paroled, September 16, 1862, at Harper’s Ferry, Va.; wounded in action, May 8, 1864, at Spotsylvania, Va.; discharged for disability from wounds, September 23, 1864; commissioned Captain, September 10, 1862, with rank from August 9, 1862, original.
While Captain Scott’s service above does not show his place of enlistment, the "Historical Register and Dictionary of the United States Array 1789-1903" shows he was bom in the State of Michigan, and appointed Captain from the State of Nevada.
In the "Military Record" furnished this office by the Town Clerk, Town of Ovid, Seneca County, New York, as required by Chapter 690, of the Laws of 1865. This record lists Winfield Scott’s address as, Post Office, Leavenworth, Kansas. Born: December 26, 1836, Ovid, New York, Fathers name: James B. Mothers name: Margaret E. Covert.
Inclosed is a copy of Special Order No.317 issued September 23,
1864, also a copy of his muster-in the service of the United State, and a sketch of the campaigns and dates in which the 126th New York Volunteer Infantry served during the Civil War.

In addition to his pension application file from which you indicate you already have received reproductions, the records of the War Department in our custody include a compiled military service record for Captain Winfield Scott, Company C, 126th Regiment New York Infantry, Union Army, and a personnel file relating to his post-Civil War military career. We can furnish you with a microfilm copy of the documents in these two files, which amount to 412 pages, for $20.60. These files include many of Captain Scott’s monthly reports of his activities. Because of restrictions on personnel documents less than 75 years old, we must exclude from reproduction all papers dated after May 1893.

One Hundred and Twenty-sixth Regiment of Infantry.
Col. Eliakim Sherrill received authority, July 15th, 1862, to raise this regiment in the counties of Ontario, Washington and Yates; it was organized at Geneva, and there mustered in the service of the United States for three years Aug. 22d, 1864. Dec. 25th, 1864, it was con-solidated into a battalion of five companies, A to E, and June 2d, 1865, the men not to be mustered out with the regiment were transferred to the 4th N. Y. Vol. Artillery.
The companies were recruited principally: A and 13 in Yates county; C and I in Seneca county; D, H and K in Ontario county; E at Geneva and Rushville; F in the counties of Ontario and Seneca; and G in Ontario, Seneca and Yates counties.
The regiment left the State Aug. 26th, 1862; it served in the Middle Department from Aug., 1862; at Harper’s Ferry, W. Va., where it was surrendered, from Sept., 1862; at Camp Douglas, Chicago, Ill., from Sept. 27th, 1862; in the Defenses of Washington, in the 1st Brigade, Casey’s Division, later 22d Corps, from Dec., 1862; in the 3d Brigade of the same, from Jan., 1863; in the 3d Brigade, 3d Division, 2d Corps, from June 25th, 1863; in the 3d, for a time in the Consolidated, Brigade, 1st Division, 2d Corps, from March, 1864; and it was honorably discharged and mustered out, under Col. J. Smith Brown, June 3d, 1865, at Washington, D. C.
During its service the regiment lost by death, killed in action, 12 officers, 95 enlisted men; of wounds received in action, 4 officers, 43 enlisted men; of disease and other causes, 1 officer, 121 enlisted men; total, 17 officers, 259 enlisted men; aggregate, 276; of whom 30 enlisted men died in the hands of the enemy; and it took part in the following engagements, etc.:

The extensive sloughing has left the limb with the muscles imperfect and producing great weakness of the limb. He reported to the medical director at Washington D.C. May 21st 1864 and received a leave of absence of 30 days from now as dating May 23 1864 at the expiration of leave he reported in accordance with the regulation until able to travel when he reported at Officers Hospital at Annapolis Maryland Sept 13th 1864 and was honorably discharged from the service by order of Secty of War Sept 23d 1864.Thus since he has left the service he has resided at Farmen Seneca County NY and has been engaged in no quarry.

He makes this Declaration in order to obtain the pension to which he is entitled by virtue of his service and the
’ disabiliity aforesaid, under the Act of Congress approved July 14th, 1862. And he hereby constitutes and appoints
Perry Scot of Elmira NY true and lawful Attorney, with full power of substitu-
ion, to presente this his claim and to receive and receipt, for any certificate, draft or money which mav be due to this deponent. Also, personally appeared Edwin A. Scott and John H. Perry residents of Elmir in the county o Chemung in said State of New York, persons whom I certify to be respectable, and entitled to credit, and who, being by me
duly sworn, say that they were present, and saw Capt. Winfield Scott sign his name to forgoing declaration; and they further swear that they have every reason to believe, from the appearance of
the applicant and their acquaintance with his, that he is the identical person he represents himself to be, and they further state that they have no interest in the prosecution of this claim.

It appears from the Rolls on file in this Office, that Winfield Scott was enrolled on the day of 186------- at ---------- in Co. ---------- regiment of-------- Volunteers, to serve -------- years, or during the war, and was mustered into service as a Captain on the 22d day of August 1862, at Geneva N.Y., in Co. "C", 126th Regiment of New York Volunteers, to serve three years, or during the war. On the Muster Roll of Co. "C" of the Regiment, for the months of May & June 1864, he is reported "Wounded May 18th 1864 absent with leave on account of wounds since May 23d 1864." On Roll for Sept. & Oct. 1864 he is reported "Honorably discharged the service on account of disability by S.O. 317 War Dept. Sept. 23d 1864." No evidentiary file to show that wounds were received in Battle or Action.

I have the honor to acknowledge the receipt of your request of August 6th, 1878,
for certain information for use in the consideration of application for pension No. 42.541, and
to return it herewith, with the following information from the records of this office:
It appears from the rolls, &c., on file in this office that Winfield Scott
was mustered into the service of the United States as Capt. Co. "C", 126 Regiment of New York Vols, to date Aug 22, 1862, to serve 3 years or during the war. On the Muster-roll of Company 'C' of that Regiment for the months of Sept and Oct, 1862, he is reported "Absent with leave severely wounded on Maryland Heights, Sept 13." He further did a Certificate dated Baltimore Sept. 23, 1862, signed by the Regimental Surgeon F. M. Hammond, stating that the wound is in the leg below the knee", and recommended a leave of absence for thirty days. He was honorably discharged Sept. 23 1864, on account of physical disability from wounds received in action, in orders of same date, from this office, based on report of Examining Board - copy furnished Pension Office. Dec. 31st 1864.

The extensive sloughing has left the limb with the muscles imperfect and producing great weakness of the limb. He reported to the medical director at Washington D.C. May 21st 1864 and received a leave of absence of 30 days from now as dating May 23 1864 at the expiration of leave he reported in accordance with the regulation until able to travel when he reported at Officers Hospital at Annapolis Maryland Sept 13th 1864 and was honorably discharged from the service by order of Secty of War Sept 23d 1864.Thus since he has left the service he has resided at Farmen Seneca County NY and has been engaged in no quarry.

Perry residents of Elmir in the county o Chemung in said State of New York, persons whom I certify to be respectable, and entitled to credit, and who, being by me
duly sworn, say that they were present, and saw Capt. Winfield Scott sign his name to forgoing declaration; and they further swear that they have every reason to believe, from the appearance of
the applicant and their acquaintance with his, that he is the identical person he represents himself to be, and they further state that they have no interest in the prosecution of this claim.

It appears from the Rolls on file in this Office, that Winfield Scott was enrolled on the day of 186------- at ---------- in Co. ---------- regiment of-------- Volunteers, to serve -------- years, or during the war, and was mustered into service as a Captain on the 22d day of August 1862, at Geneva N.Y., in Co. "C", 126th Regiment of New York Volunteers, to serve three years, or during the war. On the Muster Roll of Co. "C" of the Regiment, for the months of May & June 1864, he is reported "Wounded May 18th 1864 absent with leave on account of wounds since May 23d 1864." On Roll for Sept. & Oct. 1864 he is reported "Honorably discharged the service on account of disability by S.O. 317 War Dept. Sept. 23d 1864." No evidentiary file to show that wounds were received in Battle or Action.

I have the honor to acknowledge the receipt of your request of August 6th, 1878,
for certain information for use in the consideration of application for pension No. 42.541, and
to return it herewith, with the following information from the records of this office:
It appears from the rolls, &c., on file in this office that Winfield Scott
was mustered into the service of the United States as Capt. Co. "C", 126 Regiment of New York Vols, to date Aug 22, 1862, to serve 3 years or during the war. On the Muster-roll of Company 'C' of that Regiment for the months of Sept and Oct, 1862, he is reported "Absent with leave severely wounded on Maryland Heights, Sept 13." He further did a Certificate dated Baltimore Sept. 23, 1862, signed by the Regimental Surgeon F. M. Hammond, stating that the wound is in the leg below the knee", and recommended a leave of absence for thirty days. He was honorably discharged Sept. 23 1864, on account of physical disability from wounds received in action, in orders of same date, from this office, based on report of Examining Board - copy furnished Pension Office. Dec. 31st 1864.
